USCIS H-1B Cap Registration Rule To Take Effect in 2020 for FY 2021 Cap Season

On December 6, 2019 USCIS announced it will implement the new H-1B cap registration rule for the upcoming Fiscal Year (FY) 2021 cap season.  The rule was published on January 31, 2019 with an effective date of April 1, 2019, but implementation was postponed.  Under the rule, H-1B employers will be required to submit cap-subject petitions in the system during the initial registration period from March 1, 2020 through March 20, 2020.  Employers will pay a $10 registration fee for each H-1B cap registration.  Registration of a cap-subject petition will enter the petition in the H-1B lottery.  Employers will be required to file complete H-1B petitions for those registrations that are selected in the lottery during a filing period.  USCIS will provide additional details about the system and instructions for completing the registration process in the coming weeks.
