Fifth Circuit Court of Appeals Ruling
On January 17, 2025 the Fifth Circuit Court of Appeals partially upheld the U.S. District Court's ruling that found the DACA rule to be unlawful. In its ruling, the Court agreed with the Texas court's determination that the portions of DACA that confer lawful status and provide employment authorization violate federal immigration law. The Fifth Circuit narrowed the scope of the Texas court's injunction to the State of Texas, noting that only Texas had demonstrated standing to challenge DACA. If the Fifth Circuit's decision takes effect, residents of Texas will be unable to obtain work authorization under DACA. Whether DACA recipients residing in Texas will continue to be protected from removal may be addressed by the district court on remand. The Fifth Circuit maintained the stay that protects individuals already granted DACA. Until a final ruling on the case, DACA residents in Texas are eligible for continued DACA benefits. The Fifth Circuit's decision does not change the stay that remains in place, prohibiting USCIS from adjudicating new DACA applications.
